Former Prosecutor Now Fighting for You

Is ARD Right for Me?

When an Advocate Can Work In Your Favor

Most of the people I represent are good people caught in a bad situation. In almost every case, my clients did not realize that the drink they had at dinner or at the ball game would result in a DUI. Other times, they did not know that it was illegal to drive with a prescribed medication in their system. There are many, many situations in which a person who has been charged with a DUI is not best served by having the “book” thrown at them.

ARD, or Accelerated Rehabilitative Disposition, is a program in Pennsylvania that I have been involved with both as a prosecutor and a DUI defense lawyer. It is a pre-trial program for which you must apply for admission. If you are accepted as a candidate, your case is put on hold while you complete the program. Once you complete the ARD program, your charges are legally dismissed and you can take the next steps to have your record permanently cleared (expunged).

When An Experienced Attorney Seeks ARD, Prosecution Pays Attention

It is important to understand that the district attorney involved in your case must agree to recommend you for the ARD program. Many prosecutors are not inclined to offer ARD to persons who were involved in an automobile accident, had a high blood-alcohol content, or have other “aggravating circumstances” involved in their case. An experienced attorney can help advocate on your behalf, present the positive aspects of your life and character, and put you in the best position to be accepted into the ARD program.

At a free initial consultation, I will listen carefully to the story of the events leading up to your arrest and seek to gain an understanding of your life situation. If it seems that ARD might be a proper outcome for you, I will certainly inform you. If not, I will suggest other legal options that we may pursue to vigorously defend you against the charges.

In suburban America, where nearly everyone drives, nearly everybody at one time or another is at risk for breaking the driving laws. Once charged, you are also at risk of being convicted, if you do not hire an attorney who knows how to represent you in a court of law. Call today for an experienced DUI lawyer.

As your attorney, I will stress your attributes and the contributions you have made to society. I request that the prosecutor and the court take into account the positive areas of your life, such as in your family life, your job, your contributions to the community and other areas that reflect positively on your character. I will paint a picture of you as a whole person, so that the prosecutor can assess your complete character and see you as more than just a number charged with a crime. Sometimes it is this extra effort that can result in a person being accepted into the ARD program.
